（二）土地分配與同化時期(allotments and assimilation)(1871-1934)。

聯邦政府對待印弟安人的態度，在西元一八七一年產生了非常大的變化。由於事實上，美國在 1870
年已經控制了大部分的印弟安部落與土地，因此，於西元一八七一年三月三日，國會通過《The Indian
Appropriation Act》（印弟安撥款法），片面宣布美國境內的所有印弟安部落不再是一個獨立的國家(in-
dependent nation)，同時禁止美國聯邦政府與印弟安部落簽訂條約。而後，於西元一八八七年，國會再

度通過《The General Allotment Act》（以下簡稱 GAA，本法又可稱為 the Dawes Act，道斯法案、道
斯土地分配法），授權美國政府調查印弟安保留地，並將其土地分配給願意接受土地分配的印弟安人 7

（一般人可獲得八十公頃土地，而戶長可分配一百六十公頃土地）。 表面上，GAA 法案的目的在使印
弟安人「文明化」（將原本靠狩獵為生的印弟安人，改為以農業為生），但實際上，GAA 法案真正的

目的，是為了將印弟安土地開放給白人使用， 同時解除部落制度、習俗以及生活方式（意即，將印弟

安人「去印弟安化」）。 為了進行土地分配，美國政府第一次製作部落成員名單(enrollment list)。

（三）印弟安重建時期(the period of Indian reorganization)(1934-1945)。

西元十九世紀末，美國白人相信，讓印弟安人「去印弟安化」將有助於「改善」印弟安人的生活，
然而事實證明，前期的政策不僅無法「改善」印弟安人的生活，反而讓他們的生活越來越差（極度地貧

窮、惡劣的健康與教育狀況等）。 於是，在美國印弟安事務部（Bureau of Indian Affairs，簡稱BIA）
部長約翰·克里爾(John Collier)的建議下，美國國會通過《The Indian Reorganization Act》（全名：An
Act to conserve and develop Indian lands and resources; to extend to Indians the right to form business
and, other organizations; to establish a credit system for Indians; to grant certain rights of home rule

to Indians; to provide for vocational education for Indians; and for other purposes.以下簡稱 IRA 法案，
印弟安重建法案）。IRA 法案之主要目的，即在於透過重建印弟安政府以及部落組織，以鼓勵、強化部
落維繫其傳統與文化，並改善印弟安人之生活。 12

（四）終止（消滅）時期(the termination period)(1945-1961)。
西元一九四五年，美國政府再度變更其印弟安政策，從重建印弟安部落，再次回到同化政策。此政

策係源自於美國眾議院通過之第 108 號決定 (House concurrent resolution 108)，該決定案說明美國政府
將儘快終止對於印弟安人的差別待遇以及特殊待遇，並將印弟安人視為一般美國公民，適用美國一般法
